NE Tennessee shootout: 2 charged after incident stemming from funeral home fight

CHURCH HILL — Police believe that a verbal altercation that occurred at a funeral earlier this week escalated into an alleged exchange of gunfire late Monday night that landed two Hawkins County men in jail.Shortly before midnight Monday, the Hawkins County Sheriff’s Office was dispatched to a suspicious person at 1321 Old Union Road in Church Hill, but while en route deputies were informed of a complaint of shots fired from that address.Austin Randall Britt, 18, 123 Woodland Lane, Church Hill, told Hawkins County Central Dispatch that he and Jason Lee Derrick, 40, same address, were being shot at by Mark Richards from 1321 Old Union Road.When deputies arrived at that residence, however, witnesses there said Derrick had fired first.Our partners at the Kingsport Times-News have more on the case.

Rejected for the prom: Did jilted wannabe date stab teenage girl to death?

HARTFORD, Conn. — A 16-year-old girl was stabbed to death inside a Connecticut high school Friday, and police took a teenage boy into custody and are investigating whether the attack stemmed from her turning down an invitation to be his prom date.Emergency responders were called to Jonathan Law High School in Milford, about an hour’s drive from New York City, around 7:15 a.m. Staff members and paramedics performed life-saving measures on the girl, but she was pronounced dead shortly before 8 a.m. at Bridgeport Hospital, police said.A 16-year-old boy was taken into custody. His name wasn’t released because of juvenile offender laws, said Police Chief Keith Mello. Investigators are looking into reports that the boy stabbed the girl after she declined to be his date for the junior prom, which had scheduled for Friday night but was postponed because of the stabbing.Schools Superintendent Elizabeth Feser identified the victim as Maren Sanchez, a junior who was in the National Honor Society and engaged in school activities. Students were released from school early, and officials were offering counseling services.Students described an emotional, somewhat chaotic scene with people crying as police and paramedics swarmed the school. Students flocked to social media sites to try to find out what was going on.Sarah Golden, a 14-year-old freshman, said she was sitting in the main lobby with friends Friday morning when she was startled by several security guards running down the hall. Then she heard a voice on a walkie-talkie say that someone had been strangled. She was shocked when she learned about the stabbing.”I was trying not to freak out because it was really scary,” Sarah said. “I just don’t believe that something like that happened at my school. It’s something that seems so unreal.”Golden’s sister, Rebecca, a 17-year-old senior at the school, said she saw the victim lying on the floor surrounded by teachers, some of whom were crying. Idea to privatize Johnson City's school bus service may not have legs

City-County Liaison Committee members Thursday received a brief report from Assistant City Manager Charlie Stahl about the possibility of Johnson City’s switch to a contracted school bus service.“This is just a first look, and I do not see, at this stage of the game, a statistical advantage to outsourcing this,” Stahl told a dozen or so city and county officials.Stahl compiled some numbers from neighboring cities and counties that contract school transit services and found the average contract cost per bus was about $41,000. Based on Johnson City’s conventional 47-bus fleet, the city would likely pay a contractor $1,927,000 a year for fixed-route service.Excluding special education and transportation, personnel and operations, Johnson City’s projected total cost is $1,409,660, a difference of $517,340.“However, recognizing this difference does not factor in school bus replacement expenses that would be incurred during a particular fiscal year based on the current fleet replacement schedule,” he said. “Factoring in replacement costs of the buses over a 12-year period, and including annual personnel and operating costs for Johnson City Schools transportation (overseen by Johnson City Transit), it is estimated that the schools would pay a contractor $23,124,000 over a 12-year period.”Over that same time frame, he estimated that Johnson City Transit’s costs would be $21,145,920, nearly $1.9 million less than if a private contractor was hired to do the job. “No one’s walking to Cherokee (elementary),” said JCT Director Eldonna Janutolo. “We’re not a pedestrian-friendly city when it comes to student transportation. And when you take a school and put it in north Johnson City, it adds mileage and other costs.“It used to be when kids got to high school one person would have a car and pick up two or three others. That’s not happening today. We handle the routes and the discipline. Me and my staff handle everything else. Contractors don’t do that. If you go to a contractor, you’re going to have to consider hiring more personnel.”Stahl will soon be delivering his findings to city commissioners. But if Thursday’s meeting was any indication, Johnson City won’t be signing a contract any time soon. However, considering the weak economy and bleak preliminary budget numbers, both the city and county will discuss the matter further.City officials will be contacting Washington County Director of Schools Ron Dykes to inform him of Stahl’s findings and to see whether county school officials want to entertain the broader concept of consolidating school transportation. Johnson City Vice Mayor Stout officially kicks off run for state house

Nearly five months after confirming his intention to seek state office, Johnson City’s vice mayor announced that intention this week.On Thursday afternoon, outside Coalition for Kids at 2308 Watauga Road, Clayton Stout welcomed family and friends as he officially launched his campaign to represent District 6 in the Tennessee House of Representatives.On Nov. 13, Stout told Press staff he would be seeking the seat, which is held by state Rep. Micah Van Huss. As his supporters rallied around him Thursday afternoon, Stout said he was prepared to kick his campaign into higher gear. The two will square off in the Aug. 7 state Republican primary.“I’m excited about the opportunity to make our community even better,” Stout said. “I know I’m capable to be an effective state representative for you.”Several of Stout’s fellow city commissioners attended the launch in support of their colleague, including Johnson City Mayor Ralph Van Brocklin. Even though Van Brocklin won’t be able to vote for Stout — because he doesn’t live in the 6th District — Van Brocklin said he thought Stout would be able to bring the right type of experience to the state Legislature.“I’m a very strong supporter of Clayton Stout for state representative,” Van Brocklin said. “In the (three) years I’ve spent on the commission with Clayton, I’ve seen a huge amount of growth and a great deal of understanding about city issues, county issues, and how those two have to meld to form a successful community. With that knowledge base, I think he’s in a position to afford us much better representation than we currently have.”While Stout had previously told Press staff that he respected Van Huss, he acknowledged that there were differences between them.“There are some stark differences between myself and him,” Stout said. “I’m experienced at running a business, being a family man and having children.”In addition to differences in their personal lives, however, Stout said that residents of the 6th district had relayed concerns over issues that they felt were not being addressed in the Legislature.“That should be the priority of every representative that goes to Nashville, is to focus on issues that are concerning your constituents,” Stout said. “From what I’ve heard, the issues are education, jobs, roads (and) infrastructure. 25 cats found hanging from trees killed with blows to the head

YONKERS, N.Y. — An investigator says at least some of the 25 cats found in plastic bags hanging from trees in a New York City suburb were killed with blows to the head.Ernest Lungaro of the Westchester County SPCA said Friday that tests on three cats revealed blunt trauma to the head.He said a baseball bat, two shovels and a metal pipe were found near the scene in Yonkers. Some of the cats were just skeletons and some had been dead for only three days. A city cleanup crew found them Thursday.Lungaro said there has been some tension in the neighborhood over feeding stations some residents set up for a large population of feral cats.The SPCA and Yonkers police are investigating. Lungaro said it was too soon to say there’s a suspect.

Police charge 2 in 20-year-old Tennessee slaying

MEMPHIS — Memphis police say they have charged two men with a 20-year-old slaying after a creditable witness came forward.The Commercial Appeal reports both are charged with first-degree murder in perpetration of an attempted aggravated robbery in the 1994 death of 23-year-old Angela Perkins. Both are 36 now, but would have been juveniles at the time of the slaying.Police say Perkins’ body was found near her car on Valentine’s Day. She was on her way home from work at around 4 a.m. when she was shot.The witness who came forward in the case wasn’t identified, but police said he remained silent for so long due to threats against him and his family.

GOP Senate candidate says it's 'a bad idea' to outlaw cockfighting

FRANKFORT, Ky. — Republican U.S. Senate candidate Matt Bevin says that it was “a bad idea” to outlaw cockfighting and that he “will not support it.”Bevin made the comments during a rally on March 29 in Corbin, according to a report by WAVE TV.The comments contradict Bevin’s earlier statements that he was speaking to the group about his Senate candidacy and that he did not know it was a rally to legalize cockfighting. Bevin later told the station he does not personally support cockfighting. He said he does support the First Amendment right to free speech.Bevin is challenging U.S. Sen. Mitch McConnell in the Republican primary on May 20.

Tennessee boy's pain patch death investigated as homicide

CHATTANOOGA — Police are investigating the death of a Chattanooga toddler as a homicide after an autopsy report found that a pain patch caused his death.Chattanooga Police spokesman Tim McFarland told the Times Free Press that officers are working with the medical examiner’s office and the district attorney’s office as they investigate the death of Demarcus Bryant, who was almost 2.An autopsy report completed Saturday found that Bryant died on March 22 due to a 25-microgram fentanyl patch. The report listed the manner of death as homicide because the patch had been placed on the boy’s back “by someone else.”The report states the child’s aunt found him dead in a playpen and called authorities. The report doesn’t name the aunt or the boy’s parents.A physician at Highland Pediatrics told the newspaper that fentanyl can be used to treat children, but is usually reserved for cases of extreme pain.”It’s just like any other pain medicine,” Dr. Allen Coffman said. “It’s a narcotic and the patches are slow release, so we use that in chronic, contractible pain. The most common instances would be in children who have cancer — specifically bone cancers that can be very painful.”

VW lawyer: Automaker has deals in place outside Tennessee

NASHVILLE — Volkswagen warned Tennessee officials during difficult negotiations over incentives to expand the German automaker’s lone U.S. plant that the company has already secured offers to build a new SUV elsewhere.Volkswagen attorney Alex Leath said in a Jan. 27 email to the state Department of Economic and Community Development that the Volkswagen board would be presented options to build the new vehicle at the Chattanooga plant and or “alternative sites outside of Tennessee.”Tennessee’s $300-million incentive offer to expand the plant has been complicated by Republican politicians’ opposition to the United Auto Workers campaign to unionize workers there.”While we understand there are some ‘non-deal’ issues that are causing a delay in the TN solution, VW has been successful in reaching agreement on terms at the alternative locations,” Leath said in the email released to The Associated Press by the department.Volkswagen wants to create a German-style works council at the plant representing both hourly and salaried employees, but can’t do so without the involvement of an independent union.But Republican leaders in the state have fiercely opposed the UAW gaining a foothold with Volkswagen, arguing that it would hurt Tennessee’s ability to attract other manufacturers and suppliers. Before a February union vote, some warned the state Legislature could reject incentives if the UAW won.The UAW ended up losing that vote 712-626. And on Monday the union abandoned an appeal of the outcome to the National Labor Relations Board, urging the state to quickly approve incentives to expand the plant.In the January letter, Leath said he was drafting a memorandum of understanding “in an effort to advance the deal with Tennessee.” That draft included incentives figures Leath said Volkswagen had proposed to the state several months earlier.WTVF-TV in Nashville first reported Thursday that economic development officials responded to the draft memorandum by declaring the $300 million incentive deal was off the table.Commissioner Bill Hagerty said then in an email to a negotiating partner at Volkswagen that “circumstances have changed,” causing the state to revoke its offer.Hagerty did not specify which circumstances had changed in the email, but said he looked forward to “renewing our dialogue and determining the appropriate level and terms of state support for this important project.”The German automaker’s CEO, Martin Winterkorn, announced at the Detroit auto show in January that a new seven-passenger SUV will go on sale in the U.S. in 2016 and that production would either be in Chattanooga or at a plant in Mexico.The new SUV is part of Volkswagen’s plans to invest $7 billion in North America over the five years.Republican Gov. Bill Haslam told reporters after the NLRB challenge was withdrawn by the UAW that he hoped to quickly re-engage in talks with Volkswagen that had been stalled since January.

Police: School zone speeder charged with vandalizing friend's apartment

A school zone speeding stop Friday netted Johnson City police a man wanted on a felony vandalism from last weekend.Phillip Carr, 18, 349 High St., was stopped for speeding near Woodland Elementary School, police said. Police learned that Carr was wanted on a warrant stemming from an incident that occurred Sunday at friend’s apartment.Police said Carr was visiting his friend and was asked to leave because he was intoxicated, causing him to get angry and destroy several items in the apartment.Carr was jailed in the Washington County Detention Center on $10,000 bond pending a Sessions Court appearance Monday.

Johnson City police reported Friday that a child had been charged with stealing nearly $10,000 from a safe at a Johnson City residence.Police did not list the age or gender of the alleged offender or the exact location of the incident. The accused’s name was withheld because of age.Police said the child had opened the home safe at the residence in north Johnson City and taken cash and coins totaling about $9,900. Charged with theft over $1,000, the child was arrested at the residence and taken to the Regional Juvenile Detention Center in Johnson City. A preliminary hearing was set for today in Johnson City Juvenile Court.

Man allegedly shoots neighbor's cat, then throws it back

A Bluff City woman called police to report that her cat had accidentally been let out of her home, at which point a neighbor shot it in the head, “in front of her children.” The shooter admitted to killing the animal, due to it “stalking his brother’s chickens.” He said that when she asked for the cat back he handed it to her over the fence. Alexander Chairman of the Senate Republican Conference — the third-ranking Republican position in the United States Senate. He is the ranking Senate Republican overseeing education, labor and health, as well as energy appropriations.Wilhoit recently retired as president and chief administrative officer of the LeConte Medical Center in Sevierville.She graduated from East Tennessee State University with a Bachelor of Science in Nursing degree in 1979. Craigslist slaying: Teens charged as adults in Tennessee murder/robbery case

MEMPHIS — Two 17-year-old boys accused of murder in the fatal shooting of a Memphis man trying to sell his car on Craigslist will be tried as adults.The Commercial Appeal reports Special Judge Dan Michael ruled on Wednesday to move Martiness Henderson and Walter Collins to adult court on a charge of murder in the perpetration of a robbery. Another man, 21-year-old Brandon Vance, also faces the same charge.Police say they killed 37-year-old Larry Wilkins, who was trying to sell his 2006 Ford Mustang on Craigslist.Memphis Police Sgt. Officials say boy's remains likely incinerated in East Tennessee cabin fire

SEVIERVILLE — Officials haven’t found the remains of a 5-year-old Indiana boy who is presumed dead following a fire at a rental cabin in East Tennessee and say it’s likely they were completely incinerated.Sevier County Sheriff Office Capt. Jeff McCarter told the Knoxville News Sentinel that firefighters and investigators spent several days sifting through debris searching for any trace of Tyveon Temple of Indianapolis.”The anthropologists told us there was a great possibility the factors involved would create a complete incineration of someone that size,” he said. “Generally, we usually find some remains but they are always larger people, adults. Body mass has a lot to do with that. This child weighed approximately 40 pounds.”Other factors cited were the amount of heat generated by the blaze and its duration. McCarter said a natural gas line ruptured during the fire and created fuel for the flames.”They told us it was a great possibility (those factors) created a complete incineration of someone that size,” he said. “That’s the only explanation.”The fire broke out April 12 at a Sevierville cabin where 22 people from Kentucky and Indiana were staying.One other person, 56-year-old Ricky Hudson of Indianapolis, died after suffering severe lacerations from breaking a window in an attempt to save others. Hudson was the boy’s step-grandfather.McCarter said deputies used tracking and cadaver dogs to search the area around the cabin for the remote possibility that the child escaped unnoticed, but nothing was found.He said anthropologists used screens typical for excavating a burial site.”They were unable to find anything,” he said. “They sifted all the way to the dirt and spent five days pouring it out in buckets, every bit of debris to no avail.”The cause of the blaze was still under investigation.

WASHINGTON — The federal government wants to ban sales of electronic cigarettes to minors and require approval for new products and health warning labels under regulations being proposed by the Food and Drug Administration.While the proposal being issued Thursday won’t immediately mean changes for the popular devices, the move is aimed at eventually taming the fast-growing e-cigarette industry.The agency said the proposal sets a foundation for regulating the products but the rules don’t immediately ban the wide array of flavors of e-cigarettes, curb marketing on places like TV or set product standards.Any further rules “will have to be grounded in our growing body of knowledge and understanding about the use of e-cigarettes and their potential health risks or public health benefits,” FDA Commissioner Dr. Margaret Hamburg said.Members of Congress and public health groups have raised concerns over e-cigarettes and questioned their marketing tactics.”When finalized (the proposal) would result in significant public health benefits, including through reducing sales to youth, helping to correct consumer misperceptions, preventing misleading health claims and preventing new products from entering the market without scientific review by FDA,” said Mitch Zeller, the director of the FDA’s Center for Tobacco Products.Once the new rules are finalized, the agency could propose more restrictions on e-cigarettes. Officials didn’t provide a timetable for that action.”The devil will be in the details of future regulatory decisions,” said Jeff Stier, senior fellow at the National Center for Public Policy Research, a conservative think tank in Washington. “If the regulations are too heavy-handed, they’ll have the deadly effect of preventing smokers from quitting by switching to these dramatically less harmful alternatives.”The FDA said the public, members of the industry and others will have 75 days to comment on the proposal. The agency will evaluate those comments before issuing a final rule but there’s no timetable for when that will happen. The regulations will be a step in a long process that many believe will ultimately end up being challenged in court.E-cigarettes are plastic or metal tubes, usually the size of a cigarette, that heat a liquid nicotine solution instead of burning tobacco. That creates vapor that users inhale.Smokers like e-cigarettes because the nicotine-infused vapor looks like smoke but doesn’t contain the thousands of chemicals, tar or odor of regular cigarettes. Some smokers use e-cigarettes as a way to quit smoking tobacco, or to cut down. However, there’s not much scientific evidence showing e-cigarettes help smokers quit or smoke less, and it’s unclear how safe they are.The industry started on the Internet and at shopping-mall kiosks and has rocketed from thousands of users in 2006 to several million worldwide who can choose from more than 200 brands. Sales are estimated to have reached nearly $2 billion in 2013. Tobacco company executives have noted that they are eating into traditional cigarette sales, and their companies have jumped into the business.Some believe lightly regulating electronic cigarettes might actually be better for public health overall, if smokers switch and e-cigarettes really are safer. Others are raising alarms about the hazards of the products and a litany of questions about whether e-cigarettes will keep smokers addicted or encourage others to start using e-cigarettes, and even eventually tobacco products.”Right now for something like e-cigarettes, there are far more questions than answers,” Zeller said, adding that the agency is conducting research to better understand the safety of the devices and who is using them.At first glance, the FDA’s proposal is “broadly as expected and not as restrictive as some had feared,” Wells Fargo Securities analyst Bonnie Herzog wrote in a note to investors.In addition to prohibiting sales to minors and requiring health labels that warn users that nicotine is an addictive chemical, e-cigarette makers also would be required to register their products with the agency and disclose ingredients. They also would not be allowed to claim their products are safer than other tobacco products.They also couldn’t use words such as “light” or “mild” to describe their products, give out free samples or sell their products in vending machines unless they are in a place open only to adults, such as a bar.Companies also will be required to submit applications for premarket review within two years. As long as an e-cigarette maker has submitted the application, the FDA said it will allow the products to stay on the market while they are being reviewed. That would mean companies would have to submit an application for all e-cigarettes now being sold.

4 arrested in Greene Co. bath salts case

GREENEVILLE — Greene County Sheriff’s Office deputies have arrested four people on accusations they were marketing the synthetic drug known as “bath salts.”Tosha Franklin, Chris Key, Tiffany Norton, and Joshua Hinkle were each charged with possession of a schedule V narcotic with the intent to deliver and possession of drug paraphernalia.Sheriff Steve Burns said a vehicle valued at approximately $12,000 and approximately $3,000 in cash also were seized in the arrests. General Sessions Judge Ken Bailey Jr. ordered all four held without bond.The arrests followed a bath salts roundup earlier in this week in Greene County. Franklin also was charged in that case.

Fishing is a lot like life, learn the lessons

Believe or not, fishing replicates life. Just as we learn more about life as we live it, when we fish we not only learn lessons about catching fish, but we can apply those lessons to our non-fishing lives.So, in no particular order, here are some life lessons from the creel:Be prepared. Before you embark on your fishing adventure, have the correct rod, reel, lures and fishing line in working condition. You aren’t going to fly fish for brook trout with a rusty, salt-encrusted surf rod. If you aren’t prepared, it is your own time you waste. One time in Minnesota, I lost my last lure that was bringing in the smallmouth bass, therefore I had to jealously watch my buddy bring in one bass after another with the correct lure. I hadn’t bought enough lures before the trip. Think of times in your life when you weren’t prepared and missed an opportunity. Every day is a surprise and you never know what is going to happen. When embarking on a fishing trip we know what we are angling for — whether it is trout in our mountain streams, bass in Boone Lake, or saltwater species off the Carolina coast. Then you toss in your line, discharging your lure into the unseen depths. You may reel in the desired specie or perhaps nothing. Every now and then you hook a whopper, maybe or maybe not landing him. But that is what makes life so exciting ­— you never know what is going to happen — good or bad. When fishing or anything else you’ve got to roll with the punches, adjust to unforeseen situations, then handle them with aplomb.Patience and persistence pays off. When casting for fish even the best angler is going to come up empty more casts than not. Yet, a successful angler continues casting away, believing the next throw will be the one to hook a fish. Eventually, repeated casting results in a fish on the line. Impatient fishermen will quit before the good results happen. Fishing teaches us that if we believe in a process, and have passion for that process, to continue the process until we succeed. If I had listened to friends and family I would not have become a writer, yet I believed and stuck with it. Now here I sit more than 50 books and hundreds of columns for the Johnson City Press later.Be in the moment, and live it out. Too often we lament the past and worry about the future. Anglers have to stay focused on the now. They have to forget the big one that got away an hour ago, and not dream of a better fishing hole down the river. They have to execute the cast they are casting now. Being in the moment delivers the best chance for landing that lunker. And when you catch one relish in the event — don’t worry about to whom to brag, or posting a picture on Facebook so others can see and get jealous. There are no guarantees in life. We can’t change the past and we can’t control the future. Therefore, truly live out every day God gives you. My wife Keri Anne is the master of this. She’s always in the now and has helped me learn this life lesson. So will fishing.

Tiny fundraisers grabbed their two- and three-wheeled vehicles Wednesday morning to take part in a Trike-a-thon supporting St. Jude Children’s Research Hospital. Kids at the East Tennessee State University Child Study Center, a daycare located on Signal Drive just west of the college campus, took part in the annual event by first asking friends and family to support them in raising money for St. Jude. As a celebration of their efforts, participating children took to the daycare parking lot to ride their bicycles and tricyles in the Trike-a-thon.

2 Unicoi Co. men charged with Johnson City Walmart theft

Two Flag Pond men tried walking out of a Johnson City Walmart with more than $600 worth of merchandise Tuesday, resulting in felony shoplifting charges, police said.Ronald D. Alfano, 67, and Ian M. Alfano, 43, both of 4506 Old Asheville Hwy., Flag Pond, were arrested after the incident at the Walmart at 3111 Browns Mill Road in Johnson City. Erwin man allegedly burglarized two Johnson City homes

An Erwin man faces several charges after he allegedly burglarized two Johnson City homes Wednesday.According to police, George T. Thompson, 37, 172 Madison St., Erwin, was first spotted inside a home on West Englewood Drive. The homeowner had returned to the house around 2 p.m. Wednesday to find a man, later identified as Thompson, in the residence. The homeowner told police the burglar fled the scene riding a blue Suzuki sports bike and wearing a black-and-white helmet. A short time later, officers were called to another residential burglary, this one on Linkwood Drive, where the victim gave the same description of a burglar riding a blue motorcycle.Officers spotted the motorcycle traveling on Sundale Drive and attempted to stop Thompson, who instead pulled into a driveway, got off his bike and attempted to run from the scene, according to reports. After a short foot pursuit, Thompson was taken into custody and charged with two counts of aggravated burglary, theft of property over $500, evading arrest, simple possession and his ninth offense of driving on a suspended license. He was being held in the Washington County Detention Center on $48,000 bond pending an arraignment in Sessions Court.

Police: Afton man found with nearly 500 Xanax pills

A man suspected of driving under the influence is now facing even more trouble after a bottle containing nearly 500 Xanax pills allegedly fell out of his pants leg during a traffic stop.According to reports, Washington County Sheriff’s Office deputies stopped Lincoln Young, 24, of Afton, around 5:45 p.m. Tuesday on Highway 11E near McMackin Drive, on suspicion of driving under the influence.During the stop, a police K9 reportedly detected drugs inside the pill bottle that had allegedly fell out of Young’s pants. Further investigation revealed 465 Xanax pills in the bottle as well as a small bag of marijuana and a syringe in Young’s sock, according to reports.The street value of the pills is estimated at $2,800.Young was charged with possession of schedule IV drugs for resale, simple possession of schedule VI drugs, possession of drug paraphernalia, DUI and violation of the implied consent law. He was being held at the Washington County Detention Center on a $13,000 bond pending a court appearance.
